SUBJECT: Soil/Site Evaluation of Lot 74 in Bermuda Run, Property
of Mr. Vince Fabrizio
On September 25, 1987, Buck Hall and Charles Little accompanied me and
assisted with the soil/site evaluation of the above named property to
determine its suitability for the installation of a ground absorption
sewage treatment and disposal system for a three-bedroom house. There
is 33,250 square feet of property in a rectangular shape and water can
be obtained from a municipal system. Mr. Fabrizio was present during
the evaluation.
This lot was evaluated previously by Dan Reilly, Steve Steinbeck and
myself. My evaluation was made August 30, 1982. All of these reports
indicated the lot is unsuitable for conventional or alternative ground
absorption systems. Mr. Fabrizio changed the location of the stream
and hauled in soil material to fill a portion of the lot. He then
requested this filled portion be evaluated again. Mr. Fabrizio had a
backhoe on the property and had three holes dug to evaluate this land.
The following conditions occur.
1. The fill consists of a mixture of clay (group.IVa),loam,
sandy loam, and rounded gravel.
2. The fill material is compact, hard and massive.
3. There are colors with chroma 2 occurring at the contact
of the fill and the original soil, and in one site these
mottles were in the fill material.

This site is unsuitable for the installation of any ground absorption
system because of the unsuitable fill material and fill over an
unsuitable soil.
As it has been stated before by all who have evaluated this lot, the
whole lot is unsuitable for the installation of any ground absorption
system because of high shrink -swell clay, impeded internal drainage,
flood plain soils, shallowness to saprolite and insufficient space.
And now, in addition to the foregoing reasons, unsuitable fill material
and fill over an unsuitable soil.

We are in receipt of your letter of November 8, 1983 in which you
requested written approval for the aforementioned system to be installed
for a dwelling on lot #74. I would like to clarify the lot number on
which the system would be installed should approval be given. .According
to the Davie County.Mapping Office, the lot to be used for the system
is lot #92 not #93 as stated in your letter. This is recorded on map
no. D-8-7.
Please note below the conditions that must be met before approval
of said system could be given.
1. Written permission, on file with this office, from Duke Power
Company concerning using their Right of Way on lot #92.
2. Written easement on file with this office and with the Davie
County Register of Deeds, concerning your agreement with Mr.
Sam May, owner of lot #92. (The area of 170' x170' should
provide adequate space).
3. Plans submitted by a professional engineer, currently licensed
by the state of North Carolina. The following is the section
of the law concerning such systems as proposed and the method
of approval to be used.
.1938 Responsibilities
d. Sewage treatment and disposal systems not specifically
described in the rules of this section or any systems
which require complex pumping, treatment, or pre-treatment
before disposal, other than by a conventional septic tank,
collection sewers, structures which have not been pre-
engineered, and any other systems so specified by the local

health department shall be designed by a professional
engineer currently licensed by the state of North Carolina
and approved by the local health department. Application
rates for such systems shall be in accordance with this
section unless other rates are certified acceptable by the
professional engineer or by a soil scientist and approved
by the local health department. Plans and specifications
for such systems, including methods of operation and main-
tenance, shall be approved prior to issuance of an Improve-
ments Permit, and the Certificate of Completion shall not
be issued until the design engineer certifies to the local
health department that the system was installed in accordance
with the approved plans and specifications.
4. Signing of the necessary Release of Liability form and to
be placed on file with this office and the Davie County
Register of Deeds.
In summary, provided all the aforementioned conditions can be met,
this office stands ready and willing to assist you in every way toward
completion of this project.

With reference to the above mentioned project, the following items must be
received prior to issuing an Authorization to Construct:
1. On May 12, 1983, the Division of Environmental Management established
an administrative policy for permitting procedures for single family
residence type wastewater treatment facilities whose effluent -is
proposed to be discharged to the surface waters of the State. This
policy established a range of BOD limits where a septic tank/sand
filter system (30 ppm), a septic tank/dual sand filters in series or
a recirculating sand filter (15 to 30 ppm), or other treatment facili-
ties (less than 15 ppm) could be utilized. For discharges (such as
this one) which have an effluent limit of less than 15 ppm BOD (this
one is 5 ppm) the treatment facilities that are proposed to serve a
single family residence must be able to demonstrate through existing
and previous installations and applications of these facilities, in
similar circumstances, the ability to consistently meet the proposed
permit effluent limits. Although the information you have provided
indicates very good effluent quality for these subject facilities utilizing
recirculating sand filters, it does not demonstrate consistent compli-
ance with the proposed limits for this discharge, nor does the facili-
ties indicated appear to be very similar to your circumstance (i.e.
school systems and single family residence in cold climate). The proposed
design of a septic tank/recirculating sand filter based on the Division's
experience is not satisfactory to consistently meet effluent limit as
stringent as these. Therefore, by this evaluation and notice of inadequacy
of these facilities, the Division's NPDES Permitting Group is hereby noti-
fied of these facilities evaluation and recommended that the NPDES.permit
application be returned until satisfactory treatment facilities are pro-
posed or satisfactory data is provided justifying the use of recircula-
ting sand filters. Note that the proposed design does not meet the
Division's requirements.for design of facilities for dischargers in the
range of 15 to 30 ppm BOD since the following is not provided:

a) Satisfactory loading rate and surface area for the sand filter
based on the recirculation flowrate (i.e. QADF times the return
ratio divided by the loading rate, 600 GPD X 5 ; 5 GPD/S.F.)
b) Chlorine contact tank with volume equal to or greater than
30 minutes detention time at ADF of 600 GPD (i.e. 13 gal.)
c) Post aeration unit (i.e. cascade aerator)
d) Standby power must be provided for the recirculation pumps.
2. Please be aware that an Authorization to Construct cannot be issued for
this proposed facility until the NPDES permit is issued and as previous-
ly stated, the NPDES permit cannot be issued until a satisfactory treat-
ment scheme is proposed. A minature activated sludge or biological con-
tactor pretreatment system followed by a recirculating sand filter, with
disinfection and post aeration should provide satisfactory treatment but
will be expensive to operate. Therefore, the permit applicant must acknow-
ledge his interest in accepting .this initial and recurring cost for satis-
factory treatment of wastewater. '
The above items should be resolved as soon as possible so that your project docu-
ment can be completed without delay. Satifactory plans and specifications must be
submitted to this office no later than December 14, 1983, to prevent your project
from being subject to return as incomplete.

Dear Mr. Fabrizio:
This is in response to your application for an NPDES Permit to discharge
wastewater from a proposed single family residence. You were notified by a
letter dated June 30, 1983, that a standard septic tank -sand filter system
would not.provide the degree of treatment necessary to protect the water quality
in an unnamed tributary to the Yadkin River.
You were asked to provide a description of the treatment works for a
wastewater treatment facility that would consistently meet the effluent
limitations necessary to protect the water quality standards in the receiving
waters. You were advised no further action could be taken on your application
until this description was provided.
The additional information you have provided indicates a very good effluent
quality for facilities utilizing recirculating sand filters; it does not; as

Confirming'my telephone call to you of March 29, 1984, when I asked what
day would be convenient for you and Mrs.;.May to sign the easement agree-
ment. This.easement was for an area 170 feet by 170 feet where we will
install manifold pipes in a small portion of said area, which is mostly
under the Duke Power Company transmission lines and their right of way,
being a portion of the 2�-acre Lot 92. The septic tank would be on our
lot (74) behind your lot. This was agreed to by you and me months ago.
I was surprised that you had changed your mind. As a result, I stopped
activity and notified the Davie County Health Department not to continue
with `the review process and set aside our architect and engineers plans
and designs, as you had changed your mind.

Up until March 29, 1984, you and I had an agreement wherein I was to pay
you $2,000.00 for the easement, payment being due upon delivery to me of
the easement papers.
As you may recall, last year, when our lot was not suitable for a septic
system and yours looked as if it would be, I asked you if, for a fee, we
could use part of your 2 -2 -acre lot. First you said yes and then you said
no. Several months later you walked into my office, without an appoint-
ment, and said that for $2,000.00 you would give me an easement on your
land. I asked Phyllis and Lance Fabrizio,.who were present and officers
in our corporation, if this was agreeable, and they said it was. I then
instructedyou we had an agreement and that I would do the necessary leg
work to obtain a sanitation permit.
Since 1948
Our Officers, who also own Fabrizio & Martin, Inc., successfully constructed 22 school projects, 2 hospitals, 8 university buildings,
including the entire Fine Arts Center at U:N. Conn, and The Norwalk State Institute Buildings exceeding 100 million dollars in
projects and. 250 large houses and developed and owned Tanglewood Trails and Robin Hood Trails, Darien, Conn. Since 1966, we
have built many large homes in Sherwood Forest, Bermuda Run, Merry Acres and the Vest Mill Office Buildings.

At'tlis point,'I asked the Davie County Health"Department'to`issue me a
permit. Mr `Mando of the HealthDepartment stated I would have io Otain
a Site Evaluation Consent Form,"signed by you asythe property owner. After
you'signed'the Consent Form I hand -delivered it to Mr. Mando. He then made
the tests on your land and approved it for manifold lines. Later you asked
for a.meeting with the Health Department. Lance Fabrizio, Mr. Mando and
Mr. Hall of the Health Department, and I (Vincent Fabrizio) met you on your
lot, and when it.was explained what was to be done on your lot, you stated
that'.we could proceed, now that you understood how the lines would be in-
stalled.
Because of.our agreement, work proceeded, and prior to March 29, 1984, we
have the following expenditures:

You could have stopped our surveyors on January 9, 1984, as they were on your
lot for four hours surveying your lot and,the easement area, and not waited
until March 29, 1984, when I called to let you know all the work was completed.
Also, part of our agreement was that we would use your property until a sewer
was installed on the street in front of our lot. Evidently you listened to
gossip and never bothered to call me or to verify the facts prior to my call
to you.
In view of the expense incurred and based upon your word of agreement, we
are somewhat dismayed at the turn of events. However, I would recommend
to my people that we drop this matter, providing you pay immediately the
costs until March 29, 1984. See total above.

1. The applications submitted with this package are nondischarge applications;
however, the proposed facilities discharge to the surface waters of the State.
Therefore, NPDES applications must be submitted for review. The nondischarge
L applications will be returned upon receipt of the NPDES applications.
2. Previous waste load allocations developed for this discharge point have
produced very stringent effluent limits. Please be aware that the Division
is developing a policy which would strictly prohibit the issuance of NPDES
permits for discharges with these stringent effluent limits; since, for single
family residences, these requirements are beyond the capabilities of the best
available technology for wastewater treatment (i.e. septic tank, dual sand
filters in series, recirculating sand filters, etc.)
3. The Division's Winston Salem Regional Office and the Davie County Health Depart-
ment have discovered that you may have iniated construction of these facilities
prior to any permit being granted for the wastewater treatment and disposal
facilities. Construction of the proposed wastewater facilities prior to permit
issuance may result in enforcement action including assessment of civil penalty.
Construction of the residence without any type of permit for adequate wastewater
facilities is also a violation of county ordinance and state law and could result
in enforcement action.

A site evaluation of Lot 'r'74 in Bermuda Run subdivision
was completed the afternoon of August 28, 1,478.
A summary of the finding are:
1. Unsuitable percolation rate in excess of
120 min/inch.
2. Clayey structure with high shrink swell
potential in front and rear.
3. Indications of seasonally high water table
or at least presence of perch water condition
(obvious by presence of gray mottling in subsoil).
4. Presence of saprolite or rotten rock at level
more shallow than 4 feet.
Overall classification of this .lot is termed unsuitable
for conventional ground absorption sewage disposal system under
existing technology.

Mr. Fabrizio:
Upon your request the above mentioned lot was evaluated by lir. Steve
Steinbeck, State Soil Specialist on April 8, 1981. The purpose of said
evaluation Was to determine the soil suitability for the installation of
some type of on—site alternate sewage disposal system. I would refer you
to the previous evaluation data concerning this lot which is contained in
a letter to you dated August 29, 1978 from this office. The same results
that appear in that evaluation are holding true today. The results of the
evaluation conducted by Mr. Steinbeck confirm all the evaluation data of
August 1978.
It is the opinion of Mr. Steinbeck and this office that Lot # 74, in
Bermuda Run is unsuitable for any type of on—site ground absorption sewage
disposal system, both the conventional type and any alternate system. The
lack of soil and a perched water table are two conditions which are joined
by the stream running through the property that eliminate any type of
ground absorption system.
The only recommendation that Mr. Steinbeck and this office could make
at this time would be to pursue all available avenues with the Environmental
Managment Commission for the purpose of securing a discharge permit.

you know who installed a Recirculating Sand Filter.
In checking with Ed. Holland of the Triangle J Council of
Governments. I got the name of the Thedford Corp. Ann Arbor,
Michigan manufacturer of the Cyclette. They claim their system
is not suitable for houses because its connected to'.,toilets;and,;
not bath tubs, dishwashers and clothes washers. Priced above
twenty thousand dollars. However they gave me the dames of
two other firms that make Wastewater equipment that may be
suitable for dwellings.

REPORT: On August 30, 1982, a visit was made to the above-named property and the
following conditions were found:
1. There is a stream extending diagonally across the property. Along this stream and
occupying approximately one-half of the lot is somewhat poorly drained floodplain.
2. All of the soil on the back of the lot is high shrink -swell clay (Group IVb) with
indications of impeded internal drainage (gray drainage mottles). 'These soils are.
shallow to dense saprolite.
3. On the front of the lot most of the soil has characteristics the same as that on the
back of the lot, with one exception. That exception is one small area in the right-
hand corner, when facing the lot, that has -a small area of soil with Group.IVa clay..
This area is too thin and too small to consider for installation of a ground absorption
sewage disposal system:
I concur with all previous reports, the soils on this lot are unsuitable for
ground absorption sewage disposal systems because of the high shrink -swell clay, impeded
internal drainage, flood plain, and shallowness to saprolite.
