The on-site sewage treatment and disposal system installed
at the above mentioned location, is of such design that an Operation
Permit is required from this office. This Operation Permit is issued
instead of a Certificate of Completion. As of January.1, 1984 G.S.
[130A -337(b)] requires an Operation Permit for any system that has
the following:
Pumps and/or grease traps, any alternative
system, systems with a flow rate greater than
480 GPD, and systems serving mobile home parks.
This Operation Permit is valid as long as the sewage treatment
and disposal system is in compliance with Article 11 of G.S. Chapter
130 A, and all conditions imposed by the Operation Permit.
This letter shall serve as the aeration Permit for the
sewage treatment and disposal system at the above mentioned
location.

Mr. Fabrizio:
On May 11, 1983 the above mentioned lot was evaluated by a
representative from this office, for the purpose of installing a
ground absorption sewage treatment and disposal system to serve
a proposed dwelling. At that time holes were unable to be dug due
to the amount of rock on the site. On June 6, 1983 this lot was
again evaluated by a representative from this office. At this time your
firm had prepared -several holes for this office to evaluate the soil
conditions. On June 9, 1983 this office classified the above men-
tioned site as provisionally suitable for the installation of a
ground absorption sewage treatment and disposal system. This
classification was established on the basis of installing a very
shallow system using the top 24" of soil located in the rear portion
.of the lot behind the proposed dwelling. On June 9, 1983 permit no.
3308 was issued,to Salem Building and Realty, Ltd. showing the site
and location of proposed system. Also in this permit, were the
instructions concerning depth of system below present grade at that
date not to exceed 24".
On August 1, 1983 representatives from this office met with you
at the site and found the entire area which.was classified as pro-
visionally suitable had been totally destroyed by cutting away 32'
to 5' of soil. The 241' of provisionally suitable soil had been
removed thus leaving no suitable soil and no available space to
install the proposed system.as outlined.in the improvements permit.
Due to the removal of the provisionally suitable soil and the
lack of available space in the proposed installation area, this
office must void the improvements permit no. 3308 that was issued in
good faith on June 9, 1983. Furthermore this office would strongly
advise that all work be discontinued until a permit is secured from
this office, if at all possible.
. In summary, due to the above mentioned facts, as of August 1,

aforementioned lot was evaluated and the following conditions were ob-
served at the time of the evaluation.
1. Davie County Health Department had properly classified Lot #156
in Bermuda Run and had issued an improvement permit locating the
septic tank system on the rear of the lot adjacent to the rear
property line.
2. It was observed that the rear portion of the lot where the property's
septic tank system was to be installed had been cut, excavated and
the provisionally suitable soil removed and placed on another lot
in Bermuda Run.
3. Due to the amount of rock (round river rocks) in the remaining
soil/saprolite, it was impossible to make soil borings with a hand
operated auger.
4. It was requested that Mr. Fabrizio have some pits dug with a
.backhoe in order to continue the investigation. However, quite
frankly, it appears that additional property will have to be obtained
adjacent to this lot for the installation of a sewage treatment and
disposal system.
5. It is regrettable that the soil was removed from Lot #156. The local
health department initiated the proper action in cancelling the im-
provement permit before construction of a home on this site.

REPORT:
On August 18, 1983 a visit was made to the above-named property to make
a soil/site evaluation to determine its suitability for the installation
of a ground absorption sewage treatment and disposal system for a 4 -bedroom
house. There is about 40,000 square feet of property.
The following conditions were found at the site.
1) There is a large excavated area covering most of the lot with a
very narrow strip of soil remaining across the rear part of the
lot and a wider area of soil across the front of the lot.
-2) This area appears to be an old stream terrace. There was about 4
feet of stream deposited soil over.residual soil. The excavation
removed most of the deposited material and part of the residual
soil.
3) The residual soil,in the area excavated, that remains is variable
in depth and shallow to saprolite.
4) The soil at the rear of the lot is too small for a ground absorption.
5) The soils on the front of the lot have sand loam surface layers up
to 24 inches thick over -compact brittle sandy clay loam subsoils.
The area can be used for a low-pressure pipe system if there is
sufficient space.

There appears to be two alternatives for using this lot.
1) Evaluate the adjoining property behind the lot and if at least
provisionally suitable either buy.or lease sufficient space
to install a ground absorption system.
2) Measure front part of lot and if there is sufficient space,
install a low-pressure pipe system, fill the excavated area
behind the house with loam or coarser soil material and use this
area for repair area for low-pressure pipe system.
3) If neither of the above alternatives is feasible, the lot is
unsuitable for installation of a ground absorption system.

Mr. Fabrizio:
After many days of consideration and long drawn out conference
sessions, this office is now prepared to present our options to you
concerning a sewage treatment and disposal.system for the lot mentioned
above. Please be aware, that due to the soil removal from this lot
that any option we may present does not imply the system will work for
any given period of time. Below are the possibilities available to
your .firm.
Option;#1: Purchase the adjoining property -to the rear of lot
#156 and install a shallow conventional system as
was originally designed.
Option #2: Install a low pressure pipe system in the front yard
and do the following to the rear yard. Fill the area
that has been destroyed with a good sandy soil - this
would be.filled above present grade in order to allow
for natural setting. This area would then remain
undisturbed for a period of at least 12 months. There
could be no patio, drive, walkway, etc. in the rear
yard, as this area would serve as the repair area.
It must also be noted that when the rear area is used,
a pump will almost certainly have to be installed,
due to the elevation differences.
Option #3: Do nothing and leave site as is.; with no construction
in the site.

office and notify„.us of your intentions,. Should you select to install a
system, then we would require the necessary release of liability form to
be signed by you and recorded with the Davie County Register of Deeds.
Please advise when this office can be of further assistance concerning

The undersigned, Salem Building and Realty , Ltd., owner of property located
at Bermuda Run, Lot Number 156 ("the site") and described in instrument
recorded in Book/ZO at page Davie Public Registry, hereby acknowledges that he
applied to the Department of Health, Davie County for a permit to install a septic
tank sewage disposal system on the site; the Department evaluated the site for suita-
bility for such a system in accord with the regulations promulgated by the North Car-
olina Commission for Health Services as 10 NCAC 10A .1900 et seq; that the Depart-
ment classified the site asp evi io ll Suit ble and an appropriate permit was
issued by the Department. for �ow resure ys.
The undersigned further acknowledges that the proper design, construction and
maintenance of such septic tank system is his responsibility and that neither the De-
partment nor its officials, employees, or agents warrant or guarantee that the said
system installed pursuant to the permit issued by the Department will function in a
satisfactory manner for any given period of time, or that the Department, its offic-
ials, employees or agents assume any liability for damages, consequential or direct,
which are caused, or which may be caused, by a malfunction of such system.
This document shall be placed on the public records of the REgister of Deeds of
Davie County and indexed therein under the Grantor Index in the names or names of the
undersigned, and the foregoing acknowledgements shall henceforth be binding on all
persons claiming any right, title or interest in the site.
And the undersigned further agrees for himself, his heirs and assigns, that he
shall idemnify and hold harmless the Department and its successors, as well as Davie
County, for any damages or other claims of any person or persons whatsoever arising
out of the installation, operation, or failure, -of said septic tank system.
And the undersigned further agrees for his heirs and assigns that, in the event
any septic tank system installed under authority of the aforesaid permit fails to per-
form adequately, in any respect, he will take whatever measures are required to corr-
ect same; or if such is impossible, he will discontinue use of said system immediately
