Kizziah, late Register of Deedmn abs of Rowan County, who allegedly had om ab the original lists in the Hell of the old courthouse (See: North nd Carolina Genal vol. In; 1981, Sherburne LAUGRM, a granddaughter of Mr. KIZZIAH, found several interesting documents in her ' grandfather's files, including many of the original Lists of Taxables for 1768 of Rowan County. These } Papers were subsequently donated to the N.C. State Archives, where they are filed in Box CMC 244 of the Rowan County records. The NOGSJ Journal (Feb. 1982) published two of the 1768 lists fran that box (a par- tial list of Jacob LAESCH's and one of Matthew LOCKS) in addition to that of William SPURGIN's (stack file # C.R. 85.925.1, Box 2 at the N.C. Archives). This paper will present transcriptions from all of the extant 1768 lists of Rowan County or "about" 1768 in generally the same sequence as is shown in the court order above. The conpleted tax returns do not exactly follow the court order, and some justices included areas alotted to others. The stack file number for each list is shown in parentheses after the list heading. The arithmetical number of taxables in each list are frau the original, but many are in error. One of Carter's daughters Mary, married Daniel Boone's brother, Jonathan. By 1747 Carter and the others began to hear about the cheap and fertile lands that Lord Granville was opening In the Yadkin Valley. The Valley of Virginia was filling rapidly and if they moved quickly they would have the choice of the better lands. Although the popular image is that the settlement of the Pied- mont was Inspired by home- steading, the migration of Carter and friends bad less romantic motives. "It is impossible to conclude," Ramsey wrote, 'other than that he anI his associates agreed upon the organization and development of a settlement and town in the Yadkin Valley." Bought land Land records bear this out. Land grant and deed records show these purchases before 1763: Bryan, 4,008 acres; Hughes, 3,170 acres; Boone, 1,280; Dunn, 2,062; Forster, 1,535; and Carter, 6,674. In the meantime, the establish- ment of the new county and the new county seat was proceeding smoothly. On March 21,1754 — about seven months after the courthouse site was picked — the court announced that "James Carter Esquire, his lordship's deputy -surveyor, produced a war- rant for six hundred and forty acres of land for use of the prison courthouse and stocks & c. of said county ..." Less than a year later, on Feb. 11, 1755, the town of Salisbury was formally created when Lord Gran- ville's agents, William Churton and Richard Vigers, made the following grant to Carter and Hugh Forster, trustees: "... Six hundred and thirty five acres of land for a township ... by the name of Salisbury..'. that they might and should grant and convey in fee simple the several lots already taken up and entered ... reserving the annual rent of one shilling for each lot ... and likewise grant and convey such lots ... as are not already entered to such persons as shall respective- ly apply for the same on payment of twenty shillings..." (This, Incidentally, was the first indication the town would be named Salisbury; it had been referred to until this as Rowan Court House.) 'This arrangement is far from clear. Were Carter and Forster to act as trustees on behalf of Rowan County or Lord Granville? Did the title to the property pass to trustees Carter and Forster or to the county? Was the Granville grant a gift or a sale to the county or its trustees? And who pocketed !he 20 shillings plus annual rents of pne shilling? Flying high Carter was flying high at this period. During 1753, he bought up nearly 4,000 acres ranging from the south fork of the Catawba to the south fork of the Deep River and from the Granville line to the Moravian tract. By Feb. 27,1754, he was serving in the Colonial Assembly and had been com- missioned a major In the colonial militia. He also had indentured sgrvants and several slaves. His style of living had obviously changed in the decade since he had been rescued from the debtor's prison in Cecil County, Md. But where was all the money coming from? It became obvious in another few years that he was living and t expanding on a very modern basis — overextended credit. If not that, then graft and officeholding thievery must have been the answer. His offices offered plenty of opportunities for either, and the morality of officeholders was notoriously low. In addition to his public offices of surveyor and justice of the peace, Carter was also an innkeeper and a mill- wright. He and fellow trustee Forster . were also real estate agents. They sold not less than 100 town lots to 56 persons between 1755 and 1762. And, according to deed books, several times they sold the same lots to different people. But by the end of 1757, the bloom was fading from the Carter rose. The French and Indian War had broken out. Land sales faltered and it became hard to collect taxes and fees. Questionable deals Carter started getting involved In litigation over questionable transactions. John McGuire re- covered 0 pounds 11 shillings, and Carter lost a tract of land on Second Creek to meet that judg- ment. Carter's 350 -acre tract south of the town went to Conrad Michael In another sale. In another suit filed at Enfield, Sabinah Rigby recovered 100 pounds for a debt dating back to 1738. This should have tweaked Carter's conscience for Sabinah Rigby was the widow of William Rumsey, the Marylander who had rescued him from the debtor's prison. Carter had never repaid the 200 pounds Maryland currency he had borrowed from Rumsey. Aware that hard times were ahead, Carter began attempting to salvage what he could in 1756 by transferring to Mary Boone "all and singular my goods and chattels now belonging to my present Dwelling House ... known by the Name of Bristol Hall." Seldom have the fortunes of one man changed as abruptly as those of this "founder of Salisbury." While never personally popular, he had gained a position of wealth and perceived respectability by We change of the tide in 1757. But a humiliation far worse than the court judgments, forced sales and other financial problems awaited him that year. Carter and his old friend, John Brandon of the Irish Settlement, had been entrusted by the Colonial Assembly with 500 pounds with which to buy guns and ammunition to defend "the Frontier County of Rowan" from the depradations of the Cherokees durinLtthta Freneh and Indian war. In May 1757, the Colonial As- sembly announced that Carter ant Brandon "have neglected to Apply the said Money for the purposes aforesaid and also have hitherto neglected to Account for the same and further moved that said Jame Carter may be called by this Hous to answer for such his neglect." Fired by Assembly Unable to account for the miss- ing funds and widely suspected of having stolen them, Carter was fired from his position of justice of the peace and forced to resign his major's commission In the militia. The crowing humilitation came that November when he was kicked out of the assembly. In a footnote to that action, the Colonial Assembly in 1758 resolved that: " .. James Carter, a Surveyor In the Earl's Office (Granville), under pretence of receiving En- tries and making Surveys has at different times exacted and ex- torted considerable sums of Mone from several Persons without re- turning the same Into the Office; by which they have been preventer from getting their Deeds." The rest of Carter's years must have been gray ones. By the sprint of 1761, all of those thousands of acres he once owned had been sold or auctioned except for one tract on Potts Creek across the river from Trading Ford. He received permission to build a public grist mill, and it was there he spent the last years before his death In 1765. Perhaps It was his devious machinations that determined the location of Salisbury today. If so Salisbury has never honored him for them, for nothing, not even a street, memorializes him.
