As requested through your application, Robert B. Hall, Jr., R.S., Environmental Health
Specialist(s) with this office, visited the aforementioned site on December 17, and 18, 1998. The
purpose of said evaluations(s) was/were to determine the soil/site suitability for the installation of
an on-site sewage system. The result(s) of the evaluation(s), a copy of which is attached,
indicate(s) the site is unsuitable for the installation of an on-site sewage system for the following
reason(s):

Due to the limitation(s) on your site, this office is not aware of any modifications or alternative
measures which can be implemented at the present time to upgrade the classification from
"unsuitable" to "provisionally suitable." Your application for an Improvement
Permit/Authorization to Construct must, therefore, be denied.
You have the right to an informal review of this decision by the Environmental Health Director of
this office and also by the regional staff of the Department of Environment and Health. You
should contact this office to arrange for this further review.
You may also wish to obtain the services of a private consultant to collect site-specific data and
submit data and a system design to this office for technical review. A site may be reclassified
provisionally suitable provided written documentation, including engineering, hydrogeologic,
geologic or soil studies indicate to this office that a proposed on-site sewage system or a proposed

alternative system can reasonably be expected to function satisfactorily. The substantiating data
from these studies must indicate that:
A. The effluent (wastewater) will receive adequate treatment;
B. The effluent (wastewater) will not contaminate any ground water or surface water, and
C. The effluent (wastewater) will not be exposed on the ground surface or be discharged
to surface waters where it could come into contact with people, animals or vectors.
Finally, you have the right to a formal appeal of this decision if you file a petition for a contested
case hearing with the Office of Administrative Hearings, P. O. Drawer 27447, Raleigh, NC
27611-7447. A copy of a petition form can be provided to you upon request. The petition must be
received by the Office of Administrative Hearings within thirty (30) days of the date of this notice.
The hearing may be held in Davie County.
If you file a petition for a hearing, you must send a copy of the petition to Mr. Richard Whisnant,
DENR, Office of General Counsel, P. O. Box 27686, Raleigh, NC 27611-7687.

DEED OF EASEMENT
This deed, made this 1A day of March, 1999, by and between Patsy J. Smith ("Grantor"); and Angela Smith
Anderson and husband, Michael Douglas Anderson ("Grantees"); all of Davie County, North Carolina;
WITNESSETH:
That whereas, said Grantors are the owners of a certain tract of land as seen in Deed Book 83, page 391, and
Deed Book 183, page 119, in the office of the Register of Deeds of Davie County; and whereas, said Grantees are the
owners of a certain tract of land immediately adjoining said land of Grantors; the same being the land conveyed to them
by deed recorded in Book 208, Page 513 in the office of the Register of Deeds of Davie County; both of said deeds are
hereby referred to for greater certainty of description; and whereas, said Grantees desire to install a septic tank system
for their property; and whereas it is necessary that in so doing they lay components for said septic field across said lands
of said Grantor;
Now, therefore, said Grantor, for and in consideration of the sum of Ten Dollars, and other good and valuable
consideration, to her in hand paid, does hereby grant, bargain, sell, and convey unto said Grantees a perpetual right and
easement for a septic field described as follows:
BEGINNING at an existing iron, a common corner of the Frank Johnson lands (as seen in Deed Book 46, pate
409, and Deed Book 44, page 262), the Angela Smith Anderson and husband, Michael Douglas Anderson lands
(as seen in Deed Book 208, page 513), and the Patsy J. Smith lands (as seen in Deed Book 83, page 391, and
Deed Book 183, page 119), running thence with the Anderson line South 88° 22' 08" East 75.00 feet to a point
in the Anderson line; thence a new line South 04° 02' 54" West 150.00 feet to a point in the Smith lands; thence a
new line North 88° 22'08" West 75.00 feet to a point in the Johnson/Smith line; thence North 04° 02'54" East
150.00 feet to the POINT AND PLACE OF BEGINNING.
Said easement to allow Grantees to construct and maintain a septic field extending from said land of Grantees to a point
on Grantors lands and to go upon said lands whenever the same is reasonable necessary for the purpose of inspecting,
maintaining, and repairing said septic field; provided, and that in constructing and repairing said septic field said
Grantees removes all surplus earth, make level and surface of the ground above said septic field and interfere as little as
is reasonable possible with any plants, fences or other improvements upon the land of Grantor.
To have and to hold said right-of-way and easement to them the said Grantees and their successors in title; it
being agreed that the right-of-way and easement hereby granted is appurtenant to and runs with the land now owned by
Grantees and hereinabove referred to.
