SEWER EASEMENT
"-
This deed of sewer easement, made this 30th day 1985, by and between
George Franklin Wagner and wife, Carolyn Thomason Wagner, party of the first
part; and George Franklin Wagner, party of the second part; of Davie County,
North Carolina;
WITNESSETH:
That whereas, said parties of the first part are the owners of a certain
lot of land on the South side of Deadmon Road, the same being recorded in Deed
Book 122 at Page 211 in the Office of the Register of Deeds of Davie County; and
whereas, said party of the second part is the owner of a certain lot of land
immediately East of and adjoining said land of the party of the first -part;
the same being the land conveyed to him by Deed" in Deed Book 106 at page 597 of
the Davie County Registry; both of which deeds are hereby referred to for
greater certainty of description; and whereas, said party of the first part
wishes to erect a dwelling upon said land and install a septic tank for the use
of that dwelling; and whereas, it is necessary that in doing so the drain
field of said septic tank installed by the party of the first part encompass an
area within the property of the party of the second part;
Now, therefore, said party of the second part, for good and valuable
consideration, does hereby grant, give, and convey unto said party of the first
part a perpetual right and easement to construct a septic tank with a proper
drain field, said drain field to extend onto the property of the party of the
second part; and to go upon said lands whenever the same is reasonably
necessary for the purpose of inspecting, maintaining, and repairing said septic
tank and drain field; provided that in maintaining said septic tank and drain
field said parties of the first part remove all surplus earth, make level the
surface of 'the ground above said septic tank and drain field, and interfere as
little as is reasonably possible with any plants, fences, or other improvements
upon the land of the party of the second part.
To have and to hold said right and easement. to them the said party of the
first part and his successor in title; it being agreed that the right and
easement hereby granted is appurtenant to and runs with the land of the party
of the second part and hereinabove referred to.
In Testimony Whereof, said party of the second part have hereunto set his
hand and seal the day and year first written above.
